Lingo Driver - Terms of Use

These Terms of Use (“Terms”) govern your access to and use of services provided by Lingo Driver, including our mobile and web applications, websites, audio and speech tools, quizzes, progress tracking, and related functionality (“Services”). When you use the Services, you agree to comply with these Terms. Please also review our Privacy Policy, which explains how we collect, use, and protect your data.

1.1 You must be at least 13 years old to register. If under 18, parental or guardian permission is required.
1.2 If using the Services on behalf of a company or organization, you confirm that you have the legal authority to do so.
1.3 Account information must be accurate and kept up to date. You are responsible for all activities under your account. Do not share login credentials.

2.1 You are granted a limited, non-exclusive, non-transferable license to use the Services.
2.2 All rights, title, and interest in the Services and their content remain with Lingo Driver.
2.3 You may not reverse-engineer, decompile, scrape, or misuse the Services in any way that violates laws or these Terms.
2.4 Feedback is welcome. We may use it without obligation or compensation.

3.1 Voice recordings or text you submit are yours. You grant us rights to process this input to improve service.
3.2 We retain ownership of vocabulary content, audio lessons, learning modules, and tools.
3.3 Voice evaluations are processed in real time. We do not store recordings. Only the average pronunciation score (1-5 stars) is saved per lesson.

4.1 Some features may require a paid plan.
4.2 You authorize us to charge your selected payment method at agreed intervals.
4.3 Fees are non-refundable unless stated otherwise.
4.4 Taxes are your responsibility. Prices may be updated with advance notice.

5.1 You may access confidential content. You agree to protect this information and not disclose it unless legally required.
5.2 You must take reasonable steps to keep your login and data secure. Report breaches promptly.
5.3 If you input or manage personal data, you agree to comply with applicable data privacy laws.

6.1 These Terms remain in effect until you or we terminate your account.
6.2 We may suspend or terminate access for violations or legal reasons, with or without notice.
6.3 Upon termination, you must stop using the Services and delete confidential data.

7.1 You agree to indemnify and defend Lingo Driver from claims resulting from misuse of the Services.
7.2 The Services are provided “as is.” We make no guarantees on accuracy or performance.
7.3 Our total liability is limited to $100 or the amount paid in the last 12 months—whichever is greater.

Lingo Driver provides English language learning content designed to support vocabulary development and communication skills, particularly for commercial drivers, ride share professionals, and related users. Upon completing the course material in the app, users may have the option to take a practice-level test and receive a downloadable certificate of completion. This certificate is intended solely as recognition of participation and engagement within the Lingo Driver platform. It does not represent or substitute for any official, governmental, or internationally recognized language certification. The certificate should not be relied upon as evidence of professional qualification or language proficiency outside of the app. Lingo Driver makes no guarantees regarding third-party recognition, acceptance, or outcomes based on this certificate. Use of the certificate is entirely at the user's discretion.

9.1 Disputes are subject to mandatory arbitration, unless you opt out within 30 days of first accepting these Terms.
9.2 Before arbitration, you agree to try informal resolution by contacting support@lingodriver.com.
9.3 You may file small claims individually. Class actions and representative claims are not allowed.
9.4 Arbitration or court claims must be filed in Bradenton, Florida, under Florida law.

10.1 These Terms do not form a legal partnership or agency between you and Lingo Driver.
10.2 Do not use our name, logo, or trademarks without written permission.

10.4 We may update these Terms. Changes will be communicated via email or the app. Continued use = acceptance.
10.5 Notices may be sent by email or in-app notification.
10.6 Invalid terms will be replaced with enforceable ones. The rest remain in effect.
10.7 Do not export or use the Services in violation of U.S. law.
10.8 Breaches of IP or security may result in injunctive legal action.
10.9 These Terms are the full agreement between you and Lingo Driver.

Program name. Lingo Driver account and service notifications.

Program description. Lingo Driver sends text messages about your account and your lessons: welcome and onboarding messages, reminders to continue a lesson, trial expiry notices, payment and subscription notices, replies to your support requests, and - if you opted in to marketing - occasional offers.

How to join. Provide your phone number and check the consent box on our Text and Call Notifications page. Consent is not a condition of purchase.

Message frequency. Message frequency varies. You will typically receive no more than one message per day and no more than three per week.

Cost. Message and data rates may apply. Lingo Driver does not charge for the messages themselves; your mobile carrier may.

How to stop. Reply STOP to any message. You will receive a single confirmation and no further messages. Reply HELP for help, or contact support@lingodriver.com.

Carriers. Carriers are not liable for delayed or undelivered messages.

Privacy. See our Privacy Policy. We do not sell or share phone numbers or consent records with third parties for their own marketing.
